(1) by way of legal mortgage any freehold, leasehold or other immoveable property (including a lease made between westerby trustee services limited, richard anthony lomas and lynne beverley lomas (as trustees of the r & l lomas group sipp) (as the landlord) (1) and buxton power limited (as the tenant) (2) dated 15 october 2015 of land at waterswallows industrial park, waterswallows road, green fairfield, buxton SK17 7JB and registered at hm land registry with the title number DY503658) and any buildings, erections, fixtures or fittings from time to time situated on or forming part of such property (including any trade fixtures and fittings) and all related rights (as defined in the deed) ("real property") at the date of the deed or at any time after the date of the deed belonging to the company;. (2) by way of fixed charge any real property at the date of the deed or at any time after the date of the deed (other than the property charged at (1) above); and. (3) by way of fixed charge all present and future patents, trade marks, service marks, designs, business names, copyrights, design rights, moral rights, inventions, confidential information, know how and other intellectual property rights and interests and any similar right in any territory or jurisdiction, whether registered or unregistered, the benefit of all applications and rights to use those assets and all related rights (as defined in the deed) owned by the company (see deed for full details).
