The assigned property being all rights and interests (a) all rights and interests relating to any amount of any kind payable under the terms of any assigned contract; (b) all rights to reject or take delivery of the ship (as hereinafter defined) pursuant to the shipbuilding contract (as hereinafter defined); (c) all rights to commence, conduct, defend, compromise or abandon any legal or arbitration proceedings relating to any assigned contract or to any matter arising out of or in connection with an assigned contract; (d) all rights to damages, interest, costs or other sums payable under any judgment or order of any court, or any arbitration award, relating to any assigned contract or to any matter arising out of or in connection with an assigned contract; and (e) the warranty of eqality given by the builder in article 9.6 of the shipbuilding contract.. The borrower, to the full extent of the it's interest and with full title guarantee, charges the credit balance on: (a) the "operating account" (b) the "drydocking account" (c) the "retention account" (d) declares that each such charge shall be a first fixed charge; and (e) declares that each such charge shall be entirely distinct and independent from the other..
